Privacy notice

Who we are

AriaScout provides an autonomous recruiting agent to staffing companies. Our registered office is 5900 Balcones Dr, Suite 100, Austin, TX 78731, United States. For any question about this notice, write to privacy@ariascout.com.

Two kinds of people in our data

Customer contacts. People at staffing companies who evaluate, buy or administer the service. We hold their business contact details, account records and correspondence, and we are the controller of that data.

Candidates from a customer’s own database. People already held in a customer’s applicant tracking system. That customer is the controller, AriaScout acts as a processor under their instructions, and the records remain theirs.

Candidates sourced from job boards. People we identify through job board subscriptions held and paid for by AriaScout. We determine the means of that sourcing and act as a controller for it, within the terms of our licence with each board. When a candidate is submitted against a customer’s requisition and written into their applicant tracking system, that customer becomes a controller of the copy they hold. The submission is non-exclusive: the same individual may also be sourced for another customer’s requisition.

Aggregated network signals. Where we derive aggregated, non-identifying signals to improve scoring, we act as a controller for that limited purpose.

What we process and why

  • Professional profile data sourced from job boards under our own subscriptions, and from customer databases under customer instruction, to match candidates to requisitions.
  • Outreach and response history, to determine channel, timing and whether to continue contacting someone.
  • Voice screening recordings and transcripts, to confirm availability, rate and eligibility for a role.
  • Aggregated behavioural signals across the network, to score fit and to detect duplicate or over-submitted candidates.
  • Site usage data in aggregate, to understand traffic.

Legal bases

Where the UK GDPR, EU GDPR or a comparable law applies, we rely on:

  • Legitimate interests — sourcing, matching and recruitment outreach, being the interest of the candidate in relevant opportunities and of the customer in filling roles. We have balanced these against candidate rights and provide opt-out at first contact.
  • Performance of a contract — delivering the service to our customer, and taking steps at a candidate’s request before entering an engagement.
  • Consent — call recording where the jurisdiction requires it, and electronic marketing to customer contacts. Consent can be withdrawn at any time without affecting prior processing.
  • Legal obligation — retention and record-keeping where law requires it.

Automated decision-making

AriaScout scores and ranks candidates automatically, and decides which candidates to contact and which to submit. These decisions determine whether a candidate is put forward for a role. Every score carries a recorded rationale, and a candidate may ask for a human to review a decision that affected them by writing to privacy@ariascout.com. We do not use special category data to make these decisions.

Sharing

Candidate submissions are shared with the customer whose requisition was worked, and onward with that customer’s end client. We use subprocessors for cloud infrastructure, telephony, messaging and speech processing; a current list, with the location of each, is available from legal@ariascout.com and is provided to customers before onboarding. We do not sell personal data and we do not share it for cross-context behavioural advertising.

Retention

Retention windows are configured per customer and per jurisdiction and are agreed during onboarding rather than defaulted. Call recordings and transcripts follow the shorter of the customer’s configured window or the period permitted in the candidate’s jurisdiction. Suppression records are kept for as long as needed to honour a do-not-contact request, which is generally indefinitely, since deleting them would allow renewed contact.

International transfers

Personal data is processed in the United States. Where data originates in the EEA, the United Kingdom or Switzerland, transfers are made under the European Commission’s Standard Contractual Clauses, together with the UK International Data Transfer Addendum or the Swiss addendum as applicable, supported by a transfer impact assessment. A copy of the clauses in place is available on request.

Security

Customer data is segregated per tenant. Access is role-based, logged, and limited to staff who need it. Data is encrypted in transit and at rest. We maintain an incident response process and will notify affected customers without undue delay after becoming aware of a personal data breach, and within any period required by applicable law or the customer agreement.

Changes

If we change this notice materially we will update the date above and, for customers, give notice through the account contact on file.

Candidate rights

If AriaScout contacted you, you can ask us to:

  • Tell you what data we hold about you and where it came from.
  • Correct anything inaccurate.
  • Delete your record and suppress you from future outreach across the whole network.
  • Object to automated scoring, or ask for a human to review a decision that affected you.
  • Restrict processing while a dispute about accuracy is resolved.
  • Receive a copy of your data in a portable, machine-readable format.
  • Withdraw consent you previously gave, including for call recording.

Write to privacy@ariascout.com. We respond within 30 days for requests under the GDPR and UK GDPR, and within 45 days for requests under US state privacy laws, extendable once where the law allows and we tell you why. We do not require you to create an account, and we do not charge for a request unless it is manifestly unfounded or excessive.

Where the request concerns data held in a customer’s applicant tracking system, that customer is the controller. We will pass the request to them, act on their instruction, and confirm to you that we have done so.

If you are in the EEA or the UK you may complain to your local supervisory authority. If you are in California you may also appeal a refused request by replying to our response, and you will not be discriminated against for exercising a right.

Terms of use

This website

This site is provided for information. Figures shown in the funnel, the operations console, the candidate dossier and the ROI model are illustrative examples, not performance data, and do not form part of any agreement or performance guarantee.

The service

Use of AriaScout is governed by the master services agreement and order form signed by the customer, which take precedence over anything on this site. Nothing here creates an offer capable of acceptance.

Fees

Fees are charged on qualified submissions, scheduled interviews and confirmed placements at the rates set out in the order form. The definition of each billable event, and the process for disputing one, is set out in the agreement.

Intellectual property

AriaScout retains all rights in the platform, the models, and the aggregated network signals derived from operating the service.

Candidate records follow the sourcing path. Candidates held in a customer’s own database before AriaScout is engaged remain that customer’s entirely, and are never worked for another customer. Candidate records that AriaScout compiles from job boards, at AriaScout’s cost and under AriaScout’s subscriptions, remain part of AriaScout’s sourcing pool. On submission, the customer receives a perpetual, non-exclusive right to use that record for the requisition it was submitted against and for its ongoing relationship with the candidate. No individual person is owned by either party; these terms concern rights in compiled records, and are subject at all times to the rights of the individual set out in the candidate rights section above and to the terms of the source board.

Customers retain all rights in their requisitions, client data and end-client information. Nothing in these terms transfers ownership of either party’s pre-existing intellectual property.

Warranties

We warrant that the service will be provided with reasonable skill and care and in a professional manner. We do not warrant any particular volume of submissions, interviews or placements, any conversion rate, or any hiring outcome. Except as expressly stated, and to the fullest extent permitted by law, the service is provided without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

The customer remains responsible for its own hiring decisions, for the lawfulness of the requisitions it submits, and for compliance with employment and equal-opportunity law in the jurisdictions where it recruits.

Limitation of liability

Neither party is liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, business, goodwill or anticipated savings, whether or not the possibility of such loss was known.

Each party’s total aggregate liability arising out of or in connection with the agreement is limited to the total fees paid or payable by the customer in the twelve months immediately preceding the event giving rise to the claim.

These limits do not apply to: a party’s indemnity obligations; breach of confidentiality; infringement of the other party’s intellectual property; the customer’s obligation to pay fees; or liability that cannot lawfully be limited, including death or personal injury caused by negligence, and fraud or fraudulent misrepresentation.

Indemnities

AriaScout will defend the customer against a third-party claim that the platform, used as permitted, infringes that party’s intellectual property rights. The customer will defend AriaScout against a third-party claim arising from candidate data it supplied without a lawful basis, from a requisition that breached applicable law, or from its use of the service outside the acceptable use terms below. Each indemnity is conditional on prompt notice, sole control of the defence and reasonable cooperation.

Term and suspension

We may suspend an account, with notice where it is safe and lawful to give it, if continued operation would put candidates, the network or a third party at risk, or where required by law. Suspension does not relieve the customer of accrued payment obligations.

Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Acceptable use

Customers may not use AriaScout to:

  • Contact candidates in breach of applicable electronic communications, telemarketing, anti-spam or do-not-call rules.
  • Source or screen for roles on the basis of a protected characteristic, or in a way that has that effect.
  • Upload candidate data they do not have a lawful basis to process, or that they obtained in breach of a third party’s terms.
  • Circumvent guardrails, cadence limits, off-limits lists or suppression records.
  • Misrepresent the identity of the sender, or hold the agent out as a human when a candidate asks.
  • Resell or expose the platform’s outputs as a standalone data product.
  • Reverse engineer the platform, or use it to build a competing service.

We may suspend an account that puts candidates or the network at risk, with notice where it is safe to give it.

Cookies

This site uses only what is needed to serve the page and to understand aggregate traffic. We do not run advertising trackers, we do not sell visitor data, and we do not use cookies to build a profile of you.

  • Strictly necessary. Set by our hosting provider to route requests and protect the site. No consent is required for these and they cannot be switched off.
  • Aggregate analytics. We measure page views and traffic sources in aggregate, without cookies and without storing an identifier that follows you between sites or sessions.

Because we set no advertising or profiling cookies, there is no consent banner to dismiss. If that changes, this section will be updated and a consent mechanism added before any such cookie is set.

Next step

Bring one open requisition.

We will run AriaScout against a live req from your desk and show you exactly what comes back — the candidates, the scoring rationale and the screening transcripts.
